Document Witnesses: Florida law requires two witnesses for real estate deeds and certain estate planning documents (Wills/POAs). To keep your appointment seamless, please ensure your two chosen witnesses are present at the location with valid government-issued photo IDs. Witnesses must be independent individuals who are not named in or benefiting from the document. If you are unable to find witnesses, consider holding your appointment at a public location (like a coffee shop or library) where you can kindly ask a bystander or facility staff member to assist.
Identity Verification via Credible Witnesses: If a signer does not possess a valid government-issued photo ID, Florida law allows their identity to be verified using Credible Witnesses who can swear under oath to the signer's identity.
To utilize this method, the following statutory requirements must be met:
One (1) Credible Witness: May be used only if the witness is personally known to the Notary, personally knows the signer, possesses a valid photo ID, and is completely independent of the transaction.
Two (2) Credible Witnesses: Must be used if the witnesses are not personally known to the Notary. Both witnesses must personally know the signer, possess valid government-issued photo IDs, and have no financial or beneficial interest in the document being signed.
Fees & Processing: Administering the mandatory oath and executing the state-required Credible Witness Affidavit is billed at the standard Florida statutory fee of $10 per notarial act.
